How to Organize a Unit

Steps to Organizing a Company or Unit?

1. Initial Contact:
Contact the National Director of Organizing at 1-800-872-8488 x244 or 954-648-0399. A preliminary conversation between Union and Employee(s) is needed to determine particulars of the situation (i.e. Public or Private Sector, industry, job classification included and approximate group or unit size).

2. Authorization card signing:
A majority of the Employees would be required to sign an authorization card requesting Union representation. During this phase a communication committee would be set up as we progress.

3. Recognition requirement:
The Union requests recognition of the proposed Unit(s) to the Employer. (Either A or B happens, but not both)

A. If the Employer declines recognition, then the Union petitions the appropriate legal entity (The National Labor Relations Board NLRB or the Public Employees Relations Commission PERC) for an Employees Secret Ballot Election to select the Union to represent them for Collective Bargaining and all other terms and conditions of employment.

B. If recognition is accepted by the Employer or the legislative body, then no election would be needed. (If 3B happens we proceed to Step 6).

4. The Hearing (considering 3A above happens):
The legal entity would hold hearings to determine the appropriate Unit(s), time, date, place and all employees eligible to vote and any other legal matters that may come up under the process for a Secret Ballot Election.

5. Voting:
When the actual Vote takes place the party receiving 50% plus one (1) vote or more would win the election and become the Employees Collective Bargaining Representative certified by the legal entity usually within ten (10) to fourteen (14) days, pending no objectionable conduct.

6. Negotiations:
The parties would then begin the negotiation process once relevant requested bargaining information is received and analyzed by the Union. Prior to negotiations, Employee Contract Demand Meetings for contract input and election/selection of negotiating committee persons would take place. The Federation also sends out Collective Bargaining Questionnaires to all members so all can be heard.
